These Terms and Conditions (“Terms”) govern your access to and use of the website, booking tools, services, and interactions with Epic Septic & Service LLC (“Epic Septic,” “we,” “our,” or “us”), a Texas-based limited liability company.
By using our website, engaging our services, or submitting any information to us, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, you must immediately cease use of the website and refrain from requesting services.
Epic Septic provides septic system services, grease and grit trap cleaning, sewer line maintenance, lift station service, pressure washing, and related environmental and site services (“Services”). Services are available only within designated service areas, subject to scheduling and technician availability. We reserve the right to accept or reject service requests at our sole discretion and without explanation.
You agree to use our website and booking systems for lawful purposes only. You shall not:
Attempt to gain unauthorized access to any systems or data Misrepresent your identity, contact information, or intent
Transmit malware, spam, or any harmful code Scrape, copy, or reproduce content without permission We reserve the right to monitor activity, restrict access, or terminate accounts or sessions at any time.
a. Access Requirements
You agree to provide our technicians with clear, lawful, and safe access to all areas necessary to perform Services. Failure to do so may result in cancellation fees or rescheduling delays.
b. Permits and Approvals
You are solely responsible for obtaining any permits, homeowner association (HOA) approvals, or municipal permissions needed to complete the requested Services. We are not liable for delays or legal consequences caused by your failure to do so.
4. Estimates, Invoicing, and Payment
a. Estimates
Estimates are provided based on information available at the time and are non-binding. Final pricing may be adjusted to reflect on-site conditions, required equipment, or changes to the scope of work.
b. Payment Terms
Unless otherwise agreed in writing:
Payment is due in full upon completion of service
Late payments may incur a fee of 1.5% per month (18% APR)
We reserve the right to suspend services for non-payment
c. Collections and Fees
You are responsible for all reasonable costs of collection, including but not limited to legal fees, court costs, and third-party collection services.
We require 24 hours’ notice for cancellations or reschedules. Cancellations with less than 24 hours’ notice or failure to be present at the scheduled time may result in a minimum service charge or forfeiture of deposit. We reserve the right to reschedule, delay, or cancel services due to inclement weather, safety concerns, equipment failure, or other unforeseen circumstances.
To the maximum extent permitted by law, Epic Septic & Service LLC shall not be liable for:
Any indirect, incidental, punitive, or consequential damages Loss of business, income, use, or data
Damage caused by pre-existing conditions or third-party interference Damages exceeding the total fees paid by you for the specific service at issue You agree to indemnify, defend, and hold harmless Epic Septic, its owners, affiliates, employees, and subcontractors from any and all claims,
losses, damages, or expenses—including attorney’s fees—arising out of your misuse of services, property hazards, failure to disclose relevant information, or violations of these Terms.
You acknowledge that septic, pressure washing, and environmental services may involve inherent risks, including but not limited to property damage, soil disruption, or water intrusion. By engaging our services, you:
Accept full responsibility for ensuring your property is prepared Waive all claims against Epic Septic for damage arising from hidden infrastructure, inaccessible systems, pre-existing conditions, or third-party installations We are not responsible for issues resulting from incorrect property records, prior contractor errors, or systems not installed to code.
Unless explicitly stated in a signed written agreement:
All services are provided “AS IS” and without warranty of any kind We disclaim any implied warranties of merchantability or fitness for a particular purpose We do not guarantee system performance or life expectancy after service Any warranties offered are non-transferable and voided by misuse, alteration, lack of maintenance, or unauthorized repairs.
All content on our website—including graphics, text, branding, logos, images, videos, and code—is owned by or licensed to Epic Septic & Service LLC and is protected under U.S. copyright and trademark laws. Unauthorized reproduction or commercial use is strictly prohibited.
By submitting a review, testimonial, comment, or other content to us, you grant us a perpetual, royalty-free license to use, display, and publish that content across any marketing or public platform, with or without attribution. You agree not to post misleading, defamatory, or fraudulent content. We reserve the right to remove such content at our discretion.
Epic Septic shall not be held liable for delays, failure to perform, or damages caused by events beyond our reasonable control, including natural disasters, pandemics, labor shortages, utility failures, or acts of God.
These Terms are governed by the laws of the State of Texas. Any legal action or proceeding shall be brought exclusively in Travis County, Texas, and you consent to jurisdiction there. You waive any right to trial by jury or to participate in a class action against us.
We may update these Terms at any time without notice. Updated Terms will be posted on this page with a new “Effective Date.” Continued use of our services or website constitutes acceptance of any revisions.
If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms shall remain in full force and effect.
